Native American Graves Protection & Repatriation Act

Course Description

  • Understanding the law relating to obtaining tribal cultural items and other funerary objects, including, most importantly human remains of ancestors and other related objects is a very important aspect of protecting the general welfare of tribes and communities;
  • Pursuant to the Native American Graves and Repatriation Act, 25 U.S.C. §3001 et seq. tribal entities, native villages, and other federally recognized Indian tribes have the ability to have funerary and non-funerary objects returned to their tribe, as well as, human remains returned to identifiable lineal descendants or tribes if lineal descendants cannot be identified;
  • Understanding the processes and procedures for the return of culturally relevant objects and human remains is the key
    to success in the expeditious return of such items to the legally correct parties;
  • Learn about the legal, historical, and cultural factors required to understanding the effectivel and efficient
    implementation of this federal law at the tribal level is of utmost importance in protecting the cultural integrity of the
    tribe and its membership. Without a thorough understanding a delay will occur in the return of these culturally
    important objects and remains;
  • The law as well provides further protections of burial sites and more careful control over the removal of human remains
    and other sacred objects.
